But what is the alternative.Total authority to the likes of Laloos son,9th discontinued and now Dy Chief Minister of Bihar because his father is convicted?After all at least at the time of recruitment there is a very difficult examination which widens the horizon of the candidates greatly.

Whatever rules you may bring about , IAS 'brothers'
know how to circumvent. In effect they are 
the people who are formulating the rules in 
the first place. They insert a fine print in the voluminous

As a response to the Supreme Court's observations on the issue of "Sanction required from Competent Authority to prosecute a Public Servant for alleged misconduct,  under the Prevention of Corruption Act, 1988", the Ministry of Personnel, Public Grievances and Pensions of the Government of India has issued fresh instructions as an OM clarifying the provisions, and has sought opinion on draft procedure to be followed, from all departments.

 Excerpts:
A Private individual can seek sanction to prosecute an IAS Officer serving either with the State or the Central Govt,  for misconduct under the Prevention of Corruption Act 1988, even without supporting documents or proper proposal.

Draft procedures (attached, sourced from GoI website) have been circulated to all Govt Departments seeking their views, to be submitted by  12th August 2016, vide vide OM No.142/16/2013-AVD.I dated 21 July 2016, issued by Ministry of Personnel , Public Grievances and Pensions, GoI, and is issued after an observation made by  the Supreme Court on a case pending before it.

Such private requests will necessarily require closure in the form of a preliminary investigation,  with a report required to be sent to GoI/DoPT by the concerned State Department/Central Ministry where the IAS Officer was or is serving, within a period of 3 Months.

 Even if  the Prima Facie investigation by the concerned Department/Ministry  reveal no case, the private individual requesting such sanction is to be intimated accordingly, for pursuing a legal remedy.
